Counter-Notification (Restoring Removed Content)

If you believe that content you posted was wrongly removed due to a DMCA Notice, you may file a counter-notification. To be valid, a counter-notification must include:

1. Identification of the material that has been removed or disabled, and the location where it appeared before removal.

2. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.

3. Your name, address, telephone number, and email address.

4. A statement that you consent to the jurisdiction of the federal district court in your judicial district (or if outside the U.S., that you consent to jurisdiction in any judicial district in which the service provider may be found).

5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we may restore the removed content unless the copyright owner files a court action seeking to restrain the alleged infringement.

Repeat Infringers

In accordance with the DMCA and other applicable law, CalcViva.com reserves the right to terminate, without notice, user accounts deemed to be repeat infringers.
